Terms of Service

These Terms describe how BrandOps9 may be used to create, review, schedule and export AI-assisted marketing content. BrandOps9 is an AI system that generates content using third-party AI models.
Service use
You may use BrandOps9 to extract brand information from websites you are authorized to use, create campaigns, generate assets and prepare content for publishing. You remain responsible for reviewing generated output before publication.
Your content, brands and intellectual property
You warrant that you own, or hold all licences, consents and permissions needed to use, every brand asset you submit to or extract through BrandOps9 (including brand names, logos, trademarks, images, copy, website content and other materials) and that your use of them through the service does not infringe the intellectual-property, publicity or other rights of any third party. BrandOps9 processes these materials solely on your instruction and does not verify your entitlement to them. You are solely responsible and liable for any unauthorized use of another party's brand, logo or content through your account, and you agree to indemnify, defend and hold harmless BrandOps9, its officers and employees from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of the materials you submit, extract, generate or publish, or your breach of this warranty.
Accounts and workspaces
You are responsible for keeping your login credentials secure. Workspace owners control brand access, sharing and integrations. Shared users may receive limited permissions depending on the workspace configuration.
Generated content and human oversight
BrandOps9 generates content with AI, which can contain mistakes, omissions or unsuitable claims, so QA scoring and review tools are provided. In the standard workflow, content is not scheduled or published until a person approves it. You hold editorial responsibility for everything you publish.
No liability for AI-generated content
AI-generated output is provided 'as is' and 'as available', without warranty of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose or non-infringement. AI models can produce output that is incorrect, misleading, or similar to content generated for others, and may unintentionally resemble existing third-party works. You are responsible for reviewing all generated output and for verifying that it is accurate, lawful and does not infringe third-party rights before you use or publish it. To the fullest extent permitted by applicable law, BrandOps9 disclaims all liability for AI-generated content and for any loss or damage arising from your use, publication or distribution of it; where liability cannot be excluded, it is limited to the amount you paid for the service in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
Automated publishing (Autopilot)
If you enable Autopilot, BrandOps9 may generate, approve (against a quality score you configure) and publish content without per-item human review. By enabling Autopilot you accept editorial responsibility for content published without individual human review, and you remain responsible for any disclosures the law requires for that content.
AI transparency and your responsibilities as publisher
AI-generated images and video are marked with machine-readable 'AI-generated' provenance metadata where the format supports it. As the publisher (a 'deployer' under the EU AI Act), you are responsible for any transparency duties that apply to what you publish, for example disclosing AI-generated or manipulated images, audio or video that depict real people ('deep fakes'), or AI-generated text published to inform the public on matters of public interest. Do not use BrandOps9 to create deceptive deep fakes of real individuals.
Credits and billing
Generation, analysis and video rendering can consume credits. Paid credit packages are intended for use inside BrandOps9 and may be subject to payment-provider terms.
Acceptable use
Do not use BrandOps9 to create unlawful, deceptive, abusive, infringing or unsafe content. We may suspend access when platform security, other customers or legal compliance are at risk.
Data protection roles
For your account and usage data, BrandOps9 acts as the data controller. For the brand, campaign and audience data you process through the service, BrandOps9 acts as your processor and processes it on your instructions.
